How is a product containing THC legal in the United States?

The 2018 Farm Bill made cannabis products legal by removing hemp from the list of controlled substances. Prior to the Farm Bill, hemp was classified as a Schedule I controlled substance, alongside marijuana. However, the Farm Bill redefined hemp as an agricultural commodity and removed it from the controlled substances list. This distinction was made based on the differentiation between hemp and marijuana. Hemp is defined as cannabis with a THC (tetrahydrocannabinol) content of 0.3% or less, while marijuana contains higher levels of THC, which is responsible for its psychoactive effects.

By removing hemp from the controlled substances list, the Farm Bill legalized the cultivation, processing, and sale of hemp and hemp-derived products, including cannabis products that contain low levels of THC. This legalization opened up opportunities for the production and sale of various cannabis products, such as CBD oil, hemp fibers, and other products derived from hemp.

It’s important to note that while hemp and hemp-derived cannabis products are federally legal, the legality of marijuana and marijuana-derived cannabis products still varies by state, as marijuana remains classified as a controlled substance under federal law. Therefore, the legalization of cannabis products may differ depending on the state in which they are produced and sold.

What is Delta-8 THC?

Delta-8 THC, a psychoactive cannabinoid, is an isomer of CBD and originates from hemp and CBD. Its chemical structure sets it apart from its cousin, Delta-9 THC, with only minor differences in atomic bonds. Found in limited quantities and extracted from Hemp, Delta-8 complies with the 2018 Farm Bill, as it contains less than 0.3% Delta-9 THC, aligning with the legal requirements for Hemp products.

What is Hemp-Compliant Delta-9 THC?

“Hemp-Compliant” denotes the THC content within a product derived from Hemp. According to the Farm Bill, Hemp-derived items must not exceed a Delta-9 THC concentration of 0.3%, and this THC must originate from Hemp, not Marijuana. What is THCjd?

Unlike the three “major” cannabinoids – CBD, CBG, and THC – which possess 5-carbon sidechains, THCjd features an 8-carbon sidechain. This unique structural difference renders THCjd up to 19 times more potent than its THC counterpart. Classified as a “minor” cannabinoid, akin to THCh, THCjd is part of a growing family of minor cannabinoids that are being identified for their longer carbon sidechains, leading to increasingly potent effects.
